Power of attorney: attestation route
The US is a party to the Hague Apostille Convention. A POA can typically be notarised and then apostilled by the Secretary of State of the state where it was notarised. Some lenders still prefer attestation at an Indian Consulate (usually through its outsourced service provider). Confirm with the lender.
After it reaches India, the POA must be stamped (adjudicated) within three months, and registered if it will be used to register a property transaction. See our guide Power of attorney from abroad.
Tips
- Documents not in English may need a certified translation.
- Some lenders ask for employer letters or bank statements to be attested or stamped by the bank.
- Keep scans of everything; send originals only when the lender asks.
Typical; lenders may ask for more. This is general information, not legal advice.
