Agricultural land, plantation or farmhouseNot allowed for NRIs
Construction start deadlineSome lenders: within [X] years

*Final eligibility depends on the lender's legal and technical check of the plot.

Under India's foreign exchange rules, NRIs and OCI cardholders can generally buy residential and commercial property in India, but not agricultural land, plantation property or farmhouses (except by inheritance or as otherwise permitted). Payment must come from abroad through normal banking channels or from funds in your NRE, FCNR(B) or NRO account. This is general information, not legal advice.

NRI plot loan questions

Can an NRI buy any plot in India?

No. NRIs and OCI cardholders can buy residential and commercial plots, but not agricultural land, plantation property or farmhouses, unless inherited or specifically permitted under India's foreign exchange rules. For a plot loan, lenders usually also want the plot to be in an approved layout within municipal or development authority limits, converted to non-agricultural use where required, with a clear title and approvals. Check the RERA registration where the layout is a registered project.

Do I have to start building straight away?

Not straight away, but many lenders set a deadline. Some ask you to start or complete construction within [X years] of the plot loan disbursement. If you do not build in that time, the lender may increase the interest rate or ask you to repay. Plot loans that are later used for construction may also change how the loan is treated for tax purposes. Check the construction condition in your sanction letter before you sign.

Is a plot loan different from a home loan?

Yes. A plot loan finances land only, while a home loan finances a house or flat or its construction. Lenders usually lend a smaller share of the plot's value, for example up to [X%], and may offer shorter tenures and higher rates than for home loans. Tax deductions available for home loans generally do not apply to a plot-only loan until a house is built on it, subject to tax law. A composite loan for plot plus construction can bridge the gap.

Can I combine the plot and construction in one loan?

Yes. A composite (plot plus construction) loan funds both under one sanction. The plot part is released first, when you buy the land. The construction part is released in stages as work progresses, after the lender's engineer checks each stage. You usually pay interest only on what has been released until full disbursement, then regular EMIs. You will need an approved building plan and a construction estimate before the construction tranches are released.

Who checks the land papers?

The lender does, through its empanelled lawyer and valuer. The lawyer checks the title chain (usually [13 to 30 years], depending on the lender), the encumbrance certificate, conversion orders and layout approvals; the valuer checks the plot and its market value. Before you apply, we review the papers you have and tell you what is missing, so the lender's check goes smoothly. You should also take independent legal advice on title before paying the seller.

General information only. Lender policies vary and the lender makes the final decision.
